The Economic and Organised Crime Office has re-arrested former Chief Executive Officer of the National Food and Buffer Stock Company Limited (NAFCO), Hanan Abdul-Wahab Aludiba, and his wife Faiza Seidu Wuni, following what authorities describe as the discovery of fresh evidence.
Deputy Attorney General, Justice Srem-Sai, confirmed that the re-arrest comes after the state withdrew charges against the accused persons in the ongoing Buffer Stock case.
The High Court had earlier discharged the accused after the Attorney-General filed a notice to discontinue the prosecution. According to Dr. Srem-Sai, the decision was based on new developments that required a reassessment of the case.
“Following the discovery of fresh evidence, the Attorney-General has withdrawn from the prosecution of all the accused persons,” he stated.
Shortly after their discharge, EOCO officers moved in to re-arrest Mr. Aludiba and his wife, with authorities indicating that fresh charges will be filed.
Under Ghanaian law, a withdrawal of charges before the close of the prosecution’s case results in a discharge, not an acquittal. This means the accused persons are released from the current proceedings but can be recharged on the same or related facts.
Legal analysts say the Attorney-General’s decision to withdraw and refile is aimed at strengthening the case and ensuring a more efficient trial process.
Authorities are expected to formally present new charges once the review of the additional evidence is completed.
