Prof. Ameyaw-Akumfi, Solomon Asamoah yet to file defence 42 days after no-case ruling in $2m Sky Train case – Deputy AG.

The two accused persons in the case involving the Republic, Solomon Asamoah and Prof. Ameyaw-Akumfi, have yet to file their respective defences after the trial court dismissed their submissions of no case.

The trial court on July 2 dismissed the accused persons’ submissions of no case and directed them to file their respective defences within 21 days if they wished to do so.

According to an update from Deputy Attorney General and Minister for Justice Dr. Justice Srem-Sai, by the expiry of the 21-day period, neither accused had filed a defence. Instead, they filed an application seeking a stay of proceedings.

He added that on July 30, the court granted the accused persons an additional 21 days to file their defences, bringing the total period granted to 42 days.

The court subsequently adjourned the case to Monday, August 24, for a case management conference.

According to the Deputy AG, on August 21, a day after the expiry of the additional 21-day period, lawyers for accused Solomon Asamoah filed two applications at the Supreme Court.

He explained that the first application seeks an order of certiorari to quash the trial court’s decision dismissing his submission of no case and the variation of his bail conditions, while the second seeks an interlocutory injunction pending the determination of the certiorari application.

Dr. Srem-Sai said neither of the two accused persons has filed a defence as of the latest update.

The application for an interlocutory injunction is scheduled to be heard by the Supreme Court on August 27.
