Akosua Serwaa Fosuh, wife of the late highlife legend Charles Kojo Fosu, popularly known as Daddy Lumba, has announced plans to appeal the recent Kumasi High Court decision that dismissed her request to be recognized as the sole lawful surviving spouse.
Her lawyer, William Kusi, revealed on Monday that the appeal would be filed before the close of the day.
The case arose from a dispute over which widow is lawfully entitled to perform the widowhood rites following Daddy Lumba’s passing. The Kumasi High Court, presided over by Justice Dorinda Smith-Arthur, ruled that Akosua Serwaa’s claim was not proven beyond a reasonable doubt. The court acknowledged that both Akosua Serwaa and Priscilla Ofori—known popularly as Odo Broni—were customarily married to Daddy Lumba before his death.
However, the court rejected Akosua Serwaa’s claim of a civil marriage based on a German marriage certificate, noting that the document presented was merely an extract, not an original certificate.

Justice Smith-Arthur ruled that both women should be recognized as surviving wives and must be acknowledged by the Abusuapanyin—the family elders—in the performance of widowhood rites.
Despite the ruling, Akosua Serwaa’s counsel insists the court erred in dismissing her claim, maintaining that the evidence clearly supports her position.
Meanwhile, the final funeral rites for Daddy Lumba are scheduled for December 13, 2025, at the Baba Yara Sports Stadium in Kumasi, where the nation will gather to bid farewell to the celebrated music icon.
