Kpandai MP Matthew Nyindam Can Resume Duties After Supreme Court Suspension of Re-Run- Fatima Abubakar

Former Minister for Information Fatima Abubakar says that embattled Kpandai MP, Matthew Nyindam, can resume his parliamentary duties following the Supreme Court’s decision to suspend the re-run of the parliamentary election in the constituency.

Matthew Nyindam’s seat was declared vacant after the Speaker of Parliament acted on a Tamale High Court ruling that annulled the results of the December 7, 2024, parliamentary election. The Clerk of Parliament subsequently wrote to the Electoral Commission, informing the commission of the vacancy.

The Minority Caucus in Parliament, however, rebuked Parliament over what they described as a premature, unlawful, and dangerous notification to the Electoral Commission (EC) declaring the Kpandai parliamentary seat vacant. Deputy Minority leader Patricia Appiagyei described the notification to the Electoral Commission as a direct violation of Article 99(1)(e) of the Constitution, arguing that it prematurely treats a non-final judgment as conclusive. She also called it a breach of the separation of powers, since it effectively sidelines the appellate courts whose rulings are still pending.

on Tuesday December 17, 2025, the Supreme Court ordered the suspension of the planned parliamentary election rerun in the Kpandai constituency and directed the legal team of New Patriotic Party parliamentary candidate, Matthew Nyindam, to serve court processes on the National Democratic Congress candidate through substituted service.

The apex court issued the order after hearing an application filed by Nyindam, who is challenging the decision of the Tamale High Court that annulled the December 7, 2024, parliamentary election in the constituency.

The court subsequently adjourned the matter to January 13, 2026, for further hearing.

Reacting to the development, the former minister  Fatima Abubakar, argued that the Supreme Court’s order halting the planned re-run effectively preserves Mr Nyindam’s status as MP until a final determination is made.

Speaking to Naa Dedei Tettey on the Morning Starr on Starr FM, the member of the embattled MP’s legal team, emphasised that stripping Mr Nyindam of his parliamentary standing before the final court ruling would be premature and legally questionable.
