‘Consider an amicable settlement’- Judge advises as she adjourns Akosua Serwaa’s Injunction Application on Daddy Lumba’s Funeral to October 28

 

Presided the Kumasi High Court Her Ladyship Justice Dorinda Smith Arthur has admonished the feuding family members of the late music icon Daddy Lumba to consider an amicable out of court settlement given the stature of the late musician. The judge made the remark after adjourning hearing of an injunction application filed by Akosua Serwaa, who is seeking to be legally recognized as the only surviving spouse of the late Ghanaian music icon, Charles Kwadwo Fosu, popularly known as Daddy Lumba to October 28.

In a brief remark, the presiding judge encouraged both parties and their families to consider an amicable resolution, citing the national stature and lasting legacy of the late Daddy Lumba.

In her suit, Akosua Serwaa is asking the court to declare her as the only lawful and surviving spouse of the late musician and to affirm that she alone holds the exclusive right to perform widowhood rites.

She is also praying the court to restrain the head of the Lumba family, Kofi Owusu Fosu, from recognizing or engaging with the second defendant, Priscilla Ofori Atta, also known as Odo Broni, as a spouse of the deceased.
Additionally, she is seeking an order barring Odo Broni from publicly presenting herself as Daddy Lumba’s surviving wife.
However, during Thursday’s sitting, counsel for the first defendant filed an application challenging the legal capacity of the plaintiff, urging the court to determine that matter before proceeding with the substantive case.

Justice Dorinda Smith Arthur also noted an appearance application filed by the parties and directed all respective lawyers to file their responses and supporting documents by October 28.

The case, which has drawn widespread public attention due to the prominence of the parties involved, will resume later this month for further proceedings.
Surprising, a group of women known as “Legal Wives Association” storm the court premise to support Madam Akosua Serwaa whom they described as legal wife of the late Daddy Lumba.
The group advised men to take a lesson from the case and plan their lives better to avoid embarrassment after death.
