Suspended Chief Justice Her Ladyship Justice Gertrude Araba Torkonoo has filed another processes at the ECOWAS Community Court seeking to stop the process set in motion for her removal or reinstatement.
This follows a failed earlier attempt at the Supreme Court of Ghana seeking to stop the Pwamang Committee from proceeding with its work citing violations of her human rights.
In the case filed at the ECOWAS Community Court in Abuja, Nigeria on July 4, the suspended Chief Justice is making same allegations she made at the Apex Court of Ghana which was unanimously dismissed.
This development was disclosed by deputy Attorney General and Minister for Justice, Dr. Justice Srem-Sai.
In a Facebook post, Dr. Srem-Sai revealed the CJ and her lawyers argue in their affidavits that her suspension means she has been removed and thus unable to perform her constitutional duties.
“I can confirm that the Chief Justice – Her Ladyship, Justice Gertrude Torkornoo – has filed another court case – this time, at the ECOWAS Community Court in Abuja, Nigeria, against the Republic.” He stated.
“In the case, which was filed on July 4, Her Ladyship repeated the same allegations of human rights violations which are currently pending determination before our Supreme Court and, also, before our High Court in respect of the ongoing removal processes.” Srem-Sai revealed.
“Essentially, Her Ladyship argues that by her suspension, she “has effectively been removed from her official capacity without a final determination, impairing her right to function and serve in a position she was constitutionally appointed to.” He concluded
