Supreme Court rejects Dame’s withdrawal notice as “Defective,” adopts filings in Torkornoo case

The Supreme Court has rejected a request by former Attorney-General, Godfred Yeboah Dame to withdraw his legal representation in the case involving former Chief Justice, Gertrude Sackey Torkornoo, describing the application as “defective.”

The Court held that there was no evidence that the former Chief Justice, who is the plaintiff in the matter, had been properly served with the notice of withdrawal by her lawyers.

A seven-member panel of the Supreme Court of Ghana, presided over by Justice Amadu Tanko, noted issues of public interest in the case and consequently adopted the legal processes already filed on her behalf on record.

The Court has also directed the Registrar of the Apex Court to serve both the proceedings of the day and the withdrawal notice on the former Chief Justice. It further indicated that, upon service, she may file any additional processes before the scheduled judgment date of July 2, 2026.

The Supreme Court is expected to determine four consolidated constitutional cases challenging the processes that led to the suspension and subsequent removal of Gertrude Torkornoo as Chief Justice.

The cases include actions filed by the former Chief Justice herself against the Attorney-General and members of the committee that handled the petitions against her, as well as suits brought by other applicants challenging the process.

The matters have been consolidated into two main streams for hearing, with the Court also adopting all proposed Memoranda of Issues filed by the various parties.

The panel, which includes Justices Emmanuel Yonny Kulendi, Henry Anthony Kwofie, Senyo Dzamefe, Sir Dominic Denis Adjei, Hafisata Amaleboba, and Kweku Tawiah Ackaah-Boafo, has set July 2, 2026, for final judgment on all the consolidated constitutional cases.
